We are delighted that our competition and consumer law team led by Zhulieta Mandazhieva has helped Babich Wines win a case before the Bulgarian Commission for Protection of Competition.
The case featured the circulation of wines, labelled in a way as to imitate the products of Babich Wines. By creating labels that bear a strong visual resemblance to the labels of Babich Wines, the infringing company misled consumers about the origin of their wines, their producer, seller, method and place of production, and - most importantly - the quality of the wine offered for sale.
The overall appearance and especially the label of a wine bottle are an essential guide for determining consumers' market behaviour.
The infringing company is sanctioned financially, and the Commission imposed an injunction with immediate effect.
